The following terms and conditions (“Terms and Conditions”) apply to the provision by Dogwise Daycare Pty Ltd (“Dogwise Daycare”, "We" or “Our”) to you ("Dog Owner" or “You”) of Daycare, Boarding and other related services. By making a booking with Dogwise Daycare, You will be deemed to have accepted these Terms and Conditions. Amendments to these Terms and Conditions must be agreed in writing by us.

1. Booking

You agree to provide all contact details and other information required by Dogwise Daycare in order to accept a booking. You also agree to inform Dogwise Daycare immediately if any of those details change.

2. Deposit and Payments for Daycare/Boarding

2.1. The balance of the booking costs must be paid in full upon check-out of Your dogs(s).

2.2. Payments can be made using any of the accepted payments methods specified on the Website at the time of payment.

3. Cancellations/Refunds

3.1. You must give notice to Dogwise Daycare if You wish to cancel a booking. Twenty-four (24) hours’ notice is required to cancel a Daycare Booking. Seven (7) days’ notice is required to cancel a Boarding booking.

3.2. You agree to receive the refund as credit voucher with Dogwise Daycare to use for future bookings.

3.3. A refund of the balance of a package will be given to any associated dog that has been deemed not suitable for Daycare/Boarding at Dogwise Daycare.

4. Modifications

You must give notice to Dogwise Daycare if You wish to modify a booking. Twenty-four (24) hours’ notice is required to modify a Daycare Booking. Seven (7) days’ notice is required to modify a Boarding booking.

5. Disclosure

You must disclose of any medical conditions and behavioural history (e.g. timidness, aggressiveness etc.) of your dog(s).

6. Vaccinations

6.1. Dogs must have a complete C5 vaccination and must have completed:

a) The final course of the vaccination at least fourteen (14) days prior to the date of check-in;

b) Or a booster vaccination at least three (3) days, but not more than twelve (12) months, prior to the date of check in.

6.2. The current vaccination certificate for the dog must be provided to Dogwise Daycare either upon making the booking or prior to check-in. Dogwise Daycare reserves the right to cancel Your booking if you fail to provide the dog’s current vaccination certificate as required by this clause.

6.3. Dogwise Daycare may in its sole discretion require that the dog have additional vaccinations prior to check in to protect against additional disease or parasites not protected against by the vaccination in clause 6.1 above. In such circumstances, We will provide reasonable notice to the Dog Owner.

6.4. Dogwise Daycare does not accept Titre Testing for dogs.

7. Other Treatments Required Before Check in

7.1. All dogs must be up to date with their regular flea and worming treatment.

7.2. If worms and/or fleas are detected on the dog at check-in or during Daycare, the dog will be required to be collected immediately.

8. Entry into Daycare/Boarding

8.1. Upon arriving at the Facility, Dogwise Daycare may require a health and wellbeing examination of the dog before entry into Daycare/Boarding.

8.2. If We believe a medication examination is required for the dog before attending Daycare/Boarding, You agree to pay in full the costs of the evaluation and acknowledge and agree that there will be no refund of such costs regardless of whether or not the dog is accepted for Daycare/Boarding.

8.3. Dogwise Daycare reserves the right to refuse entry of a dog into Daycare/Boarding for any reason it considers reasonable including, but not limited to, the following reasons:

a) The dog is fifteen (15) years of age or greater;

b) The dog has previously attended a service at Dogwise Daycare and, in Our opinion, the dog is not suitable for the Facility;

c) The dog fails to pass a health and wellbeing examination;

d) The dog, in Our opinion, demonstrates aggressive behaviour; or

e) If a Dog Owner demonstrates aggressive or threatening behaviour towards any Dogwise Daycare staff member at any time during the booking process or during check-in, in which case We shall cancel Your booking for that dog.

8.4. Dogwise Daycare accepts:

a) Pups from 8 weeks of age, provided their last and full course vaccination was administered at least fourteen (14) days prior to the date of check-in.

8.5. Dogwise Daycare will not accept:

b) Alternative form of contraception or sterilisation in lieu of desexing;

c) Any female Dog under 6 (six) months of age that are not de-sexed but is in season;

d) Any diabetic dog(s);

e) Dogs with illness or disease that We deem could result in deterioration of the health and wellbeing of the dog during its stay;

f) Any dog that is pregnant or lactating; or

g) Any dog with stitches.

8.6. Any dog entering Boarding must have a ten (10) day waiting period after being desexed.

8.7. Any dog at an age greater then twelve (12) years old will require a medical check completed by a vet within one (1) month of the boarding start date and provided to Dogwise Daycare at least two (2) weeks prior to the boarding start date.

9. General Daycare/Boarding Rules

9.1. You acknowledge and agree that participation by the dog in Daycare is at the sole discretion of Dogwise Daycare.

9.2 Dogs in boarding will not be socialised during their stay, they will be exercised in a separate area. Daycare with socialisation can be arranged at an extra cost.

9.3. If the dog, in Our opinion, demonstrates aggressive behaviour/severe anxiety/stress during Daycare/Boarding, Dogwise Daycare reserves the right to:

a) Isolate the dog

b) Change the environment (e.g. pheromones); and/or

c) Request that the dog be collected from the Facility immediately by notifying the Dog Owner and/or its emergency contact, in which case We will refund the Daycare/Boarding fees for the remaining packages under the booking.

9.4. Dogwise Daycare will only permit one toy (larger than a tennis ball) or one blanket (that the dog is attached to), to be brought to the Facility for Boarding. This item must be clearly labelled with the dog’s name and surname.

10. Food

10.1. Dogwise Daycare may give dog(s) an occasional treat, therefore, all dog allergies must be disclosed by the Dog Owner.

10.2. Only Puppies from 18 weeks of age to 12 months of age will be allowed food in Daycare. This can be supplied by the owner or purchased from Dogwise Daycare.

10.3. Puppies will be fed one meal per day during Daycare as outlined in 10.2.

10.4 If food is supplied by the Dog Owner, it must:

a) Be individually packaged for the meal; and

b) In zip-lock plastic bags or clear disposable containers, with each zip-lock plastic bag or clear disposable container clearly labelled with the dog’s name.

10.5. Dogwise Daycare will not accept bags of dry dog food in their original package.

10.7. You must notify Dogwise Daycare of any special dietary requirements before the commencement of boarding and you must supply all food for the duration of your dog's stay.

10.8. All food supplied by the Dog Owner must: a) Be individually packed and portioned for each meal of each day of the dog’s boarding excluding tinned food; and b) Be in zip-lock plastic bags or clear disposable containers, with each zip-lock plastic bag or clear disposable container clearly labelled with the dog’s name, timing of meal, and date during the dog’s boarding on which the meal should be given, together with all other necessary directions.

10.9. Dogwise Daycare reserves the right to change the dog’s diet if in Our reasonable opinion the dog is experiencing stomach upset.

11. Medication

11.1. Medication will not be administered during Daycare.

11.2. All medication to be administered during Boarding must be in original packaging accompanied by veterinarian dosage instructions and clearly labelled with the dog’s name.

11.3. If the medication is not in the original packaging accompanied by veterinarian dosage, then Dogwise Daycare reserves the right to refuse administration of the medication whilst in Boarding and will not be held liable for any adverse reactions.

11.4. We will administer oral and topical medications during Boarding for the fee quoted at the time of booking.

12. Marketing and Social Media

You acknowledge and agree that at any time during the dog’s attendance at Dogwise Daycare, Your dog may be photographed and such photograph(s) may be used for marketing and/or promotion purposes on the Website and/or Dogwise Daycare’s social media accounts.

13. Veterinary Treatment during Daycare/Boarding

13.1. If the dog becomes ill or is injured during Daycare/Boarding, We will, as soon as reasonably practicable after becoming aware of such illness or injury, contact:

a) the Dog Owner; and

b) In the event that We cannot contact the Dog Owner, the emergency contact, on the phone number(s) provided in the booking form to seek instructions in relation to any treatment of the dog.

13.2. If We are unable to contact You or Your emergency contact, then You authorise Dogwise Daycare to obtain veterinary treatment for the dog, if in Our reasonable opinion such treatment is required.

13.3. You agree to:

a) authorise Dogwise Daycare to act in accordance with the veterinarian’s advice and/or instruction in respect of the treatment of the dog’s illness or injury; and

b) pay all costs associated with such veterinary treatment including but not limited to:

a. the cost of any medicines, operations and out of pocket expenses incurred by Dogwise Daycare for treatment of the dog;

b. Our Dog Transport Charges; and

c. Our fees subsisting at the time of the dog’s stay for administering any oral and/or topical medications in accordance with the veterinarian’s instruction.

14. Dog Transport Charges

14.1. Where a dog is required to be transported to a veterinarian for any reason the following charges will apply:

a) $40.00 (inclusive of GST) for transport to and from the veterinarian;

b) $35.00 (inclusive of GST) per hour for the time spent at the veterinarian by a Dogwise Daycare staff member waiting with, and being responsible for, the dog at the veterinarian; and

c) $15.00 (inclusive of GST) for the time and materials for Dogwise Daycare’s vehicle to be cleaned and sterilised.

15. Acceptance of Risk and Liability

15.1. You acknowledge and agree that:

a) The dog may during Daycare/Boarding behave in a different manner than it would normally, which may result in injury to or the death of the dog itself and/or other animals at the Facility;

b) Under no circumstances will Dogwise Daycare be held responsible for any item brought into the Facility that is lost, destroyed or left behind.

c) When your dog are in a new and unfamiliar environment, their appetite may decrease. They may also be involved in more physical activity than they are used to. Dogwise Daycare takes no responsibility for possible weight loss that may occur during your dog’s boarding stay.

15.2. Whilst every care will be taken by Dogwise Daycare during Daycare/Boarding, You acknowledge and agree that:

a) You leave the dog in the care of Dogwise Daycare at Your own risk;

b) You are solely responsible for any and all acts or behaviour of the dog during the dog’s Daycare/Boarding at the Facility; and

c) Other than as a result of negligent acts or omissions of Dogwise Daycare or its employees, Dogwise Daycare is not liable for any illness, injury or death of the dog, or caused by the dog in respect of any other dogs boarding at the Facility.

d) Dogwise Daycare uses infection control measures to minimise the spread of canine viruses etc. We also ensure that all dogs in our facility are up to date with their vaccinations. As such, Dogwise Daycare does not take any responsibility for any infections that dogs obtain whilst attending our facility.

15.3. You agree to indemnify and hold harmless Dogwise Daycare against all claims damages, costs (including without limitation legal costs on a full indemnity basis), losses, liabilities and expenses arising out of the illness or injury to or death of the dog, or any other dog at the Facility, caused by the actions of the dog, other than those arising out of Dogwise Daycare or its employees’ negligent acts or omissions.

16. Check-in and Check-out

16.1. You must drop off the dog between and 7am 6:30pm.

16.2. You must ensure that all dogs being dropped off or collected from the Facility are on a leash.

16.3. If at check-out the dog is to be collected by a person other than the Dog Owner, the Dog Owner must at check-in provide Dogwise Daycare with the name(s) and mobile phone number(s) of the person(s) authorised to collect the dog at check-out. These details will be entered in the dog’s Daycare/Boarding profile at the time of check-in. We may in Our sole discretion accept or reject any changes to the person(s) authorised to pick up the dog during Daycare/Boarding.

16.4. The Dog Owner acknowledges and agrees that the Dog Owner, Dog Owner’s emergency contact and the person(s) specified are authorised to pick up the dog.

16.5. Any dog not checked out prior to 6:30pm will be Boarded overnight at the cost of the Owner. A Daily Boarding fee and any other associated costs will be applied to the dog’s bill. See website for Boarding Fees.

17. Abandoned Dogs

17.1. If the dog is not collected within seven (7) days of the agreed departure date and no communication is received from the Dog Owner (or Dog Owner’s emergency contact or the person(s) specified (if any)) seeking to extend the boarding period of the dog, the dog will be considered abandoned.

17.2. If the dog is abandoned, You:

a) Authorise Dogwise Daycare to relinquish the dog to the local council or to place the dog in an animal shelter of Our choice; and

b) Agree that You will be responsible for the costs of the additional boarding and any expenses incurred by Dogwise Daycare, including but not limited to any applicable impoundment fees.

18. Death

18.1. If a dog dies at the Facility, We will, as soon as reasonably practicable after becoming aware of the death, contact and notify the Dog Owner or the Dog Owner’s emergency contact so that the Dog Owner’s wishes are honoured and respected in the handling and treatment of the deceased dog.

18.2. The Dog Owner acknowledges that upon the passing of a dog, the dog must be relocated from the Facility within three (3) hours of Dogwise Daycare first contacting or attempting to contact the Dog Owner or Dog Owner’s Emergency Contact.

18.3. If We are successful in contacting the Dog Owner or the Dog Owner’s emergency contact, the Dog Owner or the Dog Owner’s emergency contact shall:

a) Confirm that the Dog Owner or Dog Owner’s emergency contact will collect the deceased dog from the Facility within three (3) hours of such contact; or

b) Authorise Dogwise Daycare to relocate and transport the deceased dog from the Facility to a nearby veterinary clinic for the deceased dog to be appropriately stored until alternative arrangements in respect of the deceased dog can be made by the Dog Owner or Dog Owner’s emergency contact.

18.4. If We are unable to contact the Dog Owner or Dog Owner’s emergency contact within three (3) hours of becoming aware of the death of the dog, the Dog Owner:
a) acknowledges and agrees that Dogwise Daycare shall be authorised to relocate and transport the deceased dog from the Facility to a nearby veterinary clinic for the deceased dog to be appropriately stored until contact can be made with, and alternative arrangements can be made by, the Dog Owner or Dog Owner’s emergency contact.

19. Miscellaneous

19.1. If any provision of these Terms and Conditions is void, voidable or unenforceable, it will be read-down, limited or, if necessary, excluded to the extent required to make it not void, voidable or unenforceable, and all other terms remain in full force and effect.

19.2. These Terms and Conditions are governed by the laws of South Australia.

19.3. Dogwise Daycare reserves the right to update the terms and conditions from time to time. For the avoidance of any doubt, the terms and conditions subsisting at the time of making a booking will apply for that booking.

20. Definitions

Facility means Dogwise Daycare’s facility located at Cheltenham, South Australia;

Dog means the Dog Owner’s dog;

Dog Transport Charges means the charges set out in clause 14; and

Website means www.dogwisedaycare.com.au
